Terms & Conditions
These Terms & Conditions govern your access to and use of the Wayken website at wayken.co (the “Site”). By using the Site — including joining our waitlist — you agree to these Terms. If you do not agree, please do not use the Site. Wayken is operated by Wayken LLC (“Wayken,” “we,” “us,” or “our”).

Eligibility
You must be at least 13 years old to use the Site and to join our waitlist. By using the Site, you represent that you meet this requirement and that any information you give us is accurate.

The waitlist
If you join our waitlist, you give us an email address so we can tell you when Wayken becomes available. We use it only for that purpose, as described in the privacy note on our home page. You can ask to be removed at any time by emailing [email protected].

Mobile alerts and text messages
If you give us your mobile phone number and opt in to alerts, you consent to receive text (SMS) messages from Wayken at that number, including messages sent by an automatic telephone dialing system. Consent to receive texts is not a condition of using any Wayken product or service.
Message frequency varies. Message and data rates may apply. Reply STOP to any message to unsubscribe, or HELP for help. Delivery is handled by your mobile carrier, and we are not responsible for delays or failures outside our control. Your carrier’s terms also apply.

Intellectual property
The Site and its contents — text, graphics, logos, characters (such as Grimsby), designs, and software — are owned by Wayken LLC or its licensors and are protected by intellectual-property laws. Some of our technology is patent pending. You may view the Site for personal, non-commercial use, but you may not copy, modify, distribute, or create derivative works from it without our prior written permission.

Third-party games and services
Wayken builds AI companions intended for use alongside third-party games. Wayken is not affiliated with, endorsed by, or sponsored by any game publisher. World of Warcraft and Warcraft are trademarks of Blizzard Entertainment, Inc.; all other trademarks are the property of their respective owners.
The Site also relies on third-party tools, such as Google Analytics, which are governed by their own terms and privacy policies.

Acceptable use
You agree not to misuse the Site — for example, by attempting to gain unauthorized access, interfering with its normal operation, scraping it at scale, or using it to break the law or violate the rights of others.

Disclaimers
The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Any product features described on the Site reflect current plans and may change.

To the fullest extent permitted by law, Wayken LLC and its members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of the Site.

We may update these Terms from time to time. When we do, we will revise the "last updated" date above. If you keep using the Site after changes take effect, you accept the revised Terms.

Governing law
These Terms are governed by the laws of the United States and the state in which Wayken LLC is organized, without regard to its conflict-of-laws rules.
